1. Acceptance of Terms

By downloading, installing, or using the FretTracks mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Service Description

FretTracks is a guitar learning application that provides access to guitar scales, backing tracks, tabs, and educational content to help users improve their guitar playing skills.

2.1 Technical Requirements

• A compatible iOS device
• Active internet connection required for most features
• Sufficient device storage for temporary content caching
• Current version of iOS as supported by the App Store

3. Subscription Terms

3.1 Free Trial

• New users may be eligible for a 30-day free trial
• No payment will be charged during the trial period
• You may cancel any time during the trial without charge
• If you do not cancel before the trial ends, your subscription automatically converts to a paid monthly subscription

3.2 Monthly Subscription

• Monthly subscriptions are billed in advance on a recurring basis
• Payment will be charged to your Apple ID account upon confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription through your Apple ID Account Settings

3.3 Service Availability

• We commit to providing the FretTracks service for the duration of your active subscription period
• Service is provided "as is" and we make no guarantees regarding uninterrupted access
• We reserve the right to modify features or content within the App

4. Intellectual Property and Usage Rights

4.1 Copyright Protection

All content within the FretTracks App, including but not limited to audio files and backing tracks, musical compositions and arrangements, guitar tabs and notation, images/graphics, and educational materials, is protected by copyright and other intellectual property laws and is owned by or licensed to FretTracks.

4.2 Personal Use License

Your subscription grants you a limited, non-exclusive, non-transferable license to:

• Access and use the App content solely for your personal educational purposes
• Stream and temporarily download content for offline use within the App only

4.3 Prohibited Uses

You may not:

• Share, distribute, or publicly perform any content from the App
• Copy, download, or extract audio files, backing tracks, or other content outside the App
• Use any content for commercial purposes
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright notices or proprietary markings
• Create derivative works based on App content
• Use the App in any way that violates applicable laws or regulations

5. User Conduct

You agree to use the App responsibly and in accordance with these Terms. You will not:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the App, our servers, or networks
• Interfere with or disrupt the App's functionality or security
• Share your account credentials with others
• Use automated systems to access the App without our written permission

6. Privacy

Your privacy is important to us. Please review our Privacy Policy, which describes how we collect, use, and protect your information when you use the App. By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

7. Disclaimers and Limitation of Liability

7.1 Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

8. Indemnification

You agree to defend, indemnify, and hold harmless FretTracks and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the App.

9. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the App will cease immediately, and any downloaded content will no longer be accessible.

10. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the date at the top of these Terms and, where appropriate, provide additional notice within the App. Your continued use of the App after any changes constitutes acceptance of the new Terms.

11. Governing Law and Dispute Resolution

These Terms shall be interpreted and governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in San Diego County, California, in accordance with the rules of the American Arbitration Association.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

13. Entire Agreement

These Terms constitute the entire agreement between you and FretTracks regarding your use of the App and supersede all prior and contemporaneous written or oral agreements between you and FretTracks.
